Human trafficking in European Union
1. The definition
Before beginning deliberations on human trafficking, the definition of it must be quoted and explained. According to the “Protocol to Prevent, Suppress and Punish Trafficking in Persons, especially Women and Children”, human trafficking shall:
“mean the recruitment, transportation, transfer, harbouring or receipt of persons, by means of the threat or use of force or other forms of coercion, of abduction, of fraud, of deception, of the abuse of power or of a position of vulnerability or of the giving or receiving of payments or benefits to achieve the consent of a person having control over another person, for the purpose of exploitation. Exploitation shall include, at a minimum, the exploitation of the prostitution of others or other forms of sexual exploitation, forced labour or services, slavery or practices similar to slavery, servitude or the removal of organs.”
Basically, human trafficking is a term which is similar to slavery. Despite of abolition of slavery and the adoption of basic human rights (especially the right to freedom), staggering number of people around the world becomes a victim of modern slavery- human trafficking.
2. Historical background
Often the trafficking is seen as a marginal problem. It is believed that since outlawed slavery and introduced universal freedom, the problem has become distant and irrelevant. Confirmation of these words may be the fact that the concept of human trafficking has been defined by international law in 2000 . The adoption of the Trafficking Protocol in 2000 is widely regarded as the end of the global stagnation in combating human trafficking. The Protocol’s definition of trafficking has been adopted by all relevant United Nations organs and agencies and other intergovernmental organizations working on this issue . Moreover, after the introduction of the Protocol, many local treaties and treaty-like instruments on trafficking have been changed or developed, for example: in the 2002- South Asian Association for Regional Cooperation Convention on Preventing and Combating Trafficking in Women and Children for Prostitution, the Council of the European Union Framework Decision on Trafficking Human Beings and in the 2005- European Convention on Action against Trafficking .
3. Types of human trafficking
We distinguish several types of trafficking. First one is bonded labor, in which victim borrows money from dishonest person. The agreement consists in the fact that the victim has to work for this person until the paying off the debt. Apparently this sounds fair, but usually this person works for long periods of time, and he pays money to his boss, he is told that he still owes more money. This is a very sneaky way, because victims deeply believe that one day will regain freedom, if only they will work hard enough.
Second type is Involuntary Servitude, it means, that people are forced to work against their will. In many cases victims are recruited by the promise of better life in another country. The human traffickers sneak them illegal from their home country (usually third world countries) to richer country and then force them to do whatever they want them to do. If the victim refuse to work, the traffickers threaten to send the victims back to their country.
Domestic servitude is another common type of trafficking. Domestic servants work in rich people’s houses as maids or nannies. They also live in this houses, so it is easy to keep them hide. Sometimes this victims are not allowed to leave the house, but even if they are allowed, they mostly speak a different language than the inhabitants of the country in which they work. Situations of physical and mental abusing or shutdown in the room at night are common in this case.
The last one type of trafficking is prostitution- in this case the traffickers make money every time their victims (mostly women and children) are forced to have sex . Of course, in some countries, prostitution is legalized as a profession, but in this case is about forcing people to provide sexual services.
4. Combating human trafficking in European Union
Before the European Union began to define the proper angle of curvature of a banana or snails belonging to the world of fish, have to deal with the more important issues such as human trafficking. On June 12, 2002, the Council of the European Union adopted a Framework Decision on Combating Trafficking in Human Beings . It was a response to a growing need for a legal framework against human trafficking at EU level. This document has created a number of initiatives to help promote common action in the various areas (jurisdiction, criminal procedure, assistance to victims, police cooperation). All European Union Member States were required to have transposed the provisions of the Framework Decision into domestic legislation by July 31, 2004. This document has been heavily criticized, mainly because of the lack of concrete decisions that would serve as a real reduction of this practice. EU Council Directive on Short-term Residency Permits from 2004 supposed be the an answer to this criticism, unfortunately, did not fulfill her hopes placed upon, mostly because of the fact, that this direction adopted a “minimum-standard” version of law, which had already been introduced in European countries.
Another answer to these failures was the Proposal for a Replacement to the 2002 Framework Decision (2009-2010) . In March 2009, the Commission adopted and submitted to the Council of the European Union two proposals- first for a new Framework Decision on trafficking, and the second for a Framework Decision on combating sexual abuse and sexual exploitation of children- each aimed at strengthening the provisions of its predecessor instrument. This two proposals was very similar. It’s Decisions was introduced before the entry into force of the Treaty of Lisbon (December 1, 2009 ), but after this date, this drafts became inactivated.
5. The sad results
The United Nations “Global Report on Trafficking in Persons” shows, that this business despite the constant struggle with him, have done quite well. According to the report, most of the European countries have special provisions in their criminal codes which covers most of the forms of human trafficking . But even the best legislative situation is not able to provide completely elimination of this problem. For example, in Poland, according to the Ministry of Interior, during the period 2005-2007, there were 245 trafficking victims from Belarus, 198 from Ukraine, 28 from Bulgaria, 18 from Romania, 17 from Moldavia and 12 from Russia . By analyzing these statistics, it must be remembered, that they are understated by the low efficiency of detection of this crime. The actual size will most likely never be known.
